NY judge rules four year old can be sued

Any New York posters hear this story? Seems two girls, four and five years old, were riding their bikes w parents close by. I believe it was the 4 year old who accidentally bumped into an 87 year old woman who subsequently fractured her hip & died.

A New York judge ruled a child of four was old enough to be sued for the loss of the 87 year old woman's family. ?!?!?! What's next? They're death penalty eligible? And if the family of the elderly lady was so concerned about her, why was she out by herself on a busy street where all ages were bound to come together? I know communities for the 55+ set can legally exclude children from their communities, but a busy street? Family of one child didn't want to fight the suit but the family of the other child does.

How stupid is this? It seems to me modern Americans are bi-polar about kids. On the one hand they're infantilized...pushed in strollers when they're practically in grammar school...on the other prematurely made adults with expectations like learning to put on a condom at 12. A lot of people I know think the men & women stationed in Iraq are "just kids"...another ?!?! These folks are legally adult anywhere. Yet a NY judge ruled a four year old is old enough to be sued. ENOUGH ALREADY...even cultures which consider kids adults at earlier ages than mainstream Americans the ages are 15 (Mexican coming of age "quinceanera" party, kind of like Sweet 16 party for a young woman) and 12 & 13 (Jewish girl and boy respectively). The youngest to be executed by electrocution in South Carolina was 14 (wrong but still he was not four and the laws of South Carolina call for adjudication of kids into adult court for capital murder at 14). Yet some feel 18 & 19 year olds are too young to serve the military or get married...get on Lithium or some other mood stabilizer already this is ridiculous!

Holy fucking shit! How in the hell is a four-year-old supposed to understand something like that? It was an accident! Even if she was an adult, I'd still say how the hell can you sue someone for something like that? It's not like she deliberately rammed the woman with her bike and shoved her into the street to kill her.

...and even if she did ram her on purpose, a four-year-old is not fully awareof her actions and the consequences.

Damn straight. And what do they think they'll get as compensation, her favourite stuffed animal, all the pennies in her piggy bank? And how do her parents explain this to her? I bet this poor child will now have a lifelong fear of riding bikes and maybe even of driving cars and will probably need years of therapy. This is horrible!

To many drinks the night before at dinner or his or her club I say. First the lady didn't die from getting bumped persay, only as a result of her hip damage, but maybe her medical care was not correct? And even if she did again the child is 4? She doesn't even probably understand that older people are older people? Yep! do many drinks or something.

first of all that's the justice system for you. There' is many dirty things happening in there with plea bargains and everything else. I was watching this movie about something with how they were being rather unethical. anyhow, I don't think the family had a good defense lawyer. Technically the lawyer could have fought for the family and the judge and jurry given the kid infancy and charged the parents.

Okay. I think that if the kid had done this on purpose, the lady should have been able to sue the parents, but for one thing, it was an accident, and for another, the child probably didn't have the maturity to understand the fact that because of the lady's age, it's very likely that she would have suffered damage besides a scraped knee and a bruised arm, as the child would if the same thing had happened to them.

It's a poor little girl. She doesn't have the fine motor skills yet to control her bike perfectly, and she can not be expected to pay perfect attention to her surroundings yet. So I broke my grandmother's computer when I was four and cost her over $2000 replacing in and its contents. So a little girl dropped a twenty pound weight on my hand when I was nine and smashed my ring finger. So I forgot to tell mother the steps were icy and she fell and broke her leg. All of which happened. Yeah a lot of the examples are among my family and friends, but accidents happen, especially when you're little.
Agreed with the previous poster. If you're concerned about dear old grandma, don't let her wander od a busy street!

Are these idiots suing clueless about the fact that an 87 year old has a much higher chance of immediate death than a younger person? At some point in the near future she might have died w/o being injured? What about her was worth suing a child did they lose out on a free babysitter for their brats and now they have to pay one?

I guess I shouldn't be surprised that a judge in New York of all places made this ruling. This Mona Charen book "Do Gooders" is a real eye opener. Seems the state of New York was the first to start actively recruiting any and everyone to apply for welfare benefits. The whole "judgementalism" of classifying poor for assistance as "deserving" or "undeserving" ended, and the citizens of NY were seen as entitled to a minimum standard of living without actually working for it.
